Terms of Sale & Limited Warranty

This page explains how Hoyme Manufacturing Inc. sells and supports our products, and what is covered under our limited warranty.

By placing an order with Hoyme or one of our authorized distributors, you agree to the Terms of Sale and Limited Warranty described below.

TERMS OF SALE

Pricing & Quotations

All prices are shown in Canadian dollars unless otherwise stated and are subject to change without notice. Written quotations from Hoyme are valid only for the period stated on the quotation.

Orders & Acceptance

Orders are subject to acceptance by Hoyme Manufacturing Inc. We may reject or adjust orders that contain errors, obsolete items, or quantities below our minimum order value.

Payment Terms

Unless otherwise agreed in writing, payment terms for approved credit accounts follow the terms shown on your Hoyme invoice. Late payments may be subject to interest charges and suspension of further shipments. New accounts or special orders may be required to prepay.

Freight & Risk of Loss

Shipments are normally sent prepaid and charge or collect, using carriers selected by Hoyme unless you request otherwise. Risk of loss or damage passes to the purchaser when the shipment is delivered to the carrier. Claims for shipping damage or loss must be made directly with the carrier.

Taxes & Duties

All sales are subject to applicable sales taxes, duties, brokerage, and other government charges. These charges are the responsibility of the purchaser and may be added to the invoice where required.

Returns & Credits

Returned goods require prior authorization from Hoyme. Non-stock, custom, or modified products are generally non-returnable except where covered by warranty. Approved returns must be shipped prepaid, in resalable condition, and may be subject to a restocking charge. Credits will be issued only after inspection and approval.

Product Changes

Hoyme may improve or change product designs without notice, as long as the change does not negatively affect function or certification.

Governing Law

These Terms of Sale are governed by the laws of the Province of Alberta and the laws of Canada applicable therein. Any dispute will be handled in the courts of Alberta, Canada.

LIMITED WARRANTY

Coverage

Hoyme Manufacturing Inc. warrants that Hoyme-manufactured products will be free from defects in materials and workmanship under normal use and service for:

Electrical Components

From date of purchase

10 Years

Mechanical Components

From date of purchase

At Hoyme's option, defective products covered by this warranty will be repaired or replaced with a comparable product, free of charge for the product itself. Any replacement product is warranted only for the remainder of the original warranty period.

Who is Covered

This warranty applies to the original purchaser of the product from Hoyme or from an authorized distributor, and to subsequent owners of the installation where local law permits.

Exclusions & Limitations

What is not covered

This limited warranty does not cover damage or failure caused by:

Incorrect installation, wiring, or application
Improper electrical supply, voltage spikes, or lack of proper electrical protection
Misuse, abuse, negligence, or modification of the product
Use with non-approved equipment or in non-HVAC applications
Normal wear, cosmetic damage, or damage during shipment to Hoyme

Products that have been altered, repaired, or tampered with by anyone other than Hoyme or an authorized service provider are not covered.

Limitation of Liability

Hoyme Manufacturing Inc.'s total responsibility is limited to repair or replacement of the defective product as described above.

Hoyme will not be liable for any indirect, incidental, special, or consequential damages, including but not limited to lost profits, loss of use, or damage to other equipment or property, arising from the sale, installation, or use of our products, even if we have been advised of the possibility of such damages.

How to Make a Warranty Claim

⚠ Do not return product to the wholesaler or supplier without authorization from Hoyme.

Receive Return Instructions

If a return is required, Hoyme will issue instructions and a return authorization. Products must be returned prepaid to Hoyme's facility for evaluation.

Evaluation & Resolution

If the product is found to be defective and covered by this warranty, Hoyme will repair or replace the product at no charge for the product itself. If the product is not covered, Hoyme may quote repair or replacement options.

Warranty claims will not be processed without proof of purchase.
